The rules that govern using this website and working with us — what we commit to, what we need from you, who owns what, and what happens if something goes wrong. Written to be read, not to hide behind.

You own your site & accounts No lock-in, ever Last updated September 28, 2026
The short version

Use the site sensibly and don't copy our work. If we build something for you, you pay per the agreed schedule, we deliver what was scoped, and once you've paid in full the work is yours — domain, site, accounts, no lock-in. We can't guarantee rankings or revenue, and our liability is capped at what you paid us. Your signed proposal always overrides this page.

01Agreement to these terms

By accessing scalixdigital.com or engaging Scalix Digital for services, you agree to these Terms of Service. If you don't agree with them, please don't use the site or engage us.

If you're accepting these terms on behalf of a company or other organisation, you confirm you have the authority to bind that organisation to them.

Signed agreements come first. Where you have a signed proposal, statement of work or service agreement with us, that document governs the engagement. These terms fill the gaps and apply to anything the contract doesn't cover — they never override it.

03Using this website

You're welcome to browse, read and share this site. You agree not to:

  • ✓Copy, reproduce or republish substantial parts of the site's design, code or written content without our written permission.
  • ✓Attempt to gain unauthorised access to the site, its servers or any connected systems.
  • ✓Use automated tools to scrape, harvest or overload the site.
  • ✓Submit false information, spam or malicious content through our forms.
  • ✓Use the site for any unlawful purpose or in a way that damages our reputation.

We may suspend or block access if we reasonably believe any of the above is happening.

04Our services

We provide the services described on this website. Specific deliverables, timelines and pricing for your project are set out in a written proposal or statement of work agreed before the engagement begins.

Anything described on this site — service descriptions, package contents, indicative pricing — is a general overview rather than a binding offer. The proposal you sign is the definitive scope.

05Quotes, scope & proposals

Prices shown on this website (Launch from $500, Scale from $1,200, Authority from $2,500, Growth Retainer from $400 per month) are starting points, not fixed quotes. Final pricing depends on scope, page count, integrations, content requirements and timeline.

Written quotes are valid for 30 days unless stated otherwise.

Changes to scope

Work outside the agreed scope — additional pages, new features, extra revision rounds, or a change of direction after sign-off — is quoted separately and agreed in writing before it starts. We won't do out-of-scope work and invoice you for it as a surprise, and equally we won't absorb significant additional work without a conversation.

06Payment terms

  • ✓Deposit — projects begin on receipt of the deposit set out in your proposal. Scheduling is confirmed at that point, not before.
  • ✓Milestones — remaining payments follow the schedule in your proposal, typically tied to project phases.
  • ✓Retainers — billed monthly in advance and continue until cancelled with the notice period stated in your agreement.
  • ✓Final payment — due before launch or handover unless agreed otherwise in writing.
  • ✓Late payment — invoices unpaid past their due date may lead to work being paused. We'll always tell you before pausing anything.
  • ✓Third-party costs — hosting, domains, premium plugins, stock assets, ad spend and similar are either billed at cost or paid directly by you, as agreed in the proposal.

All prices are exclusive of any applicable taxes unless stated otherwise. Deposits are non-refundable once work has commenced, as they reserve capacity we've turned other work away for.

07Project timelines

Timelines quoted in proposals are estimates made in good faith based on the scope agreed and on receiving what we need from you when we need it.

Most website builds run six to eight weeks; brand identity projects three to five weeks. The two things that move a timeline are content readiness and approval speed on your side. Delays in either shift the schedule accordingly, and we'll flag it as soon as it happens rather than at the end.

We're not liable for delays caused by circumstances outside our reasonable control, including third-party service outages, hosting problems or force majeure events.

08Your responsibilities

Projects run well when both sides know what they own. Here's the split.

We handle
  • ✓Strategy, design, build and QA
  • ✓Technical setup and integrations
  • ✓Testing across devices before launch
  • ✓Clear updates on progress and blockers
You provide
  • ✓Content, images and brand assets
  • ✓Access to domains, hosting and accounts
  • ✓Timely feedback and a named approver
  • ✓Accurate business information

You confirm that any content, images, logos or materials you supply are ones you own or are licensed to use. You agree to indemnify us against claims arising from material you provided that infringes someone else's rights.

09Revisions & approval

Each project includes the number of revision rounds set out in your proposal. A revision round means consolidated feedback from your side, returned in one batch, rather than piecemeal changes over several weeks.

Once a phase is approved in writing, we move forward on that basis. Returning to a previously approved phase — a new design direction after build has started, for example — is treated as new work and quoted separately.

If we don't hear back on a deliverable within 14 days, we may treat it as approved so the project doesn't stall indefinitely. We'll chase you before that happens.

10Intellectual property

What you own

On full payment, ownership of the final deliverables created specifically for you transfers to you — the website design and build, brand identity and source files, and the content we produced for your project. Your domain, hosting, analytics and search accounts are yours throughout and are set up in your name.

What we retain

  • ✓Pre-existing tools, frameworks, code libraries and internal processes we bring to the project.
  • ✓Unused concepts and design directions not selected by you.
  • ✓General know-how, methods and techniques used in the work.

We grant you a perpetual, non-exclusive licence to use any of our pre-existing materials embedded in your deliverables, for the purpose of operating what we built.

No lock-in. We don't use proprietary page builders that stop working if you leave, and we don't hold your accounts hostage. Until final payment is made, ownership remains with us — after it, everything is yours to take anywhere.

11Third-party services

Projects commonly rely on third-party platforms — WordPress, Shopify, hosting providers, Google services, CRMs, payment processors and plugins. These are governed by their own terms and pricing, which you accept when using them.

We're not responsible for outages, price changes, policy changes, deprecations or data loss caused by third-party services. Where a third party materially changes something that affects your setup, we'll tell you and propose a path forward, which may be quoted as additional work.

12Portfolio & credit

Unless you tell us otherwise in writing, we may display completed work in our portfolio, on this website, in proposals and on social media — including screenshots, your business name and a description of what we delivered.

If your project is confidential or under embargo, just let us know and we'll keep it out of our portfolio entirely.

13Confidentiality

Both sides agree to keep confidential any non-public business information shared during an engagement — commercial data, strategy, customer information, pricing and internal processes — and to use it only for the purposes of the project.

This doesn't apply to information that is already public, was known before disclosure, is independently developed, or must be disclosed by law. Where a separate NDA is signed, that document takes precedence.

14Results & no guarantees

We commit to doing the work described in your proposal to a professional standard. We do not, and cannot honestly, guarantee specific business outcomes.

  • ✓Search rankings — no agency controls Google's ranking systems. We commit to correct technical foundations, architecture and content, and to reporting you can verify in your own Search Console.
  • ✓Traffic, leads or revenue — these depend on your market, pricing, offer, competition, sales process and factors outside our control.
  • ✓Advertising performance — paid media results vary with platform costs, competition and creative fatigue.

Anyone in this industry guaranteeing a number one ranking or a fixed revenue figure is making a promise they can't keep. We'd rather set expectations you can hold us to.

15Warranties & disclaimers

We warrant that services will be performed with reasonable skill and care by suitably qualified people.

Beyond that, this website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the site will be uninterrupted, error-free or free of harmful components.

Post-launch defects

We'll correct genuine defects in our work — things that don't function as specified — reported within 30 days of launch, at no charge. This doesn't cover changes to scope, new feature requests, issues caused by third-party updates, or changes made by you or another party after handover.

16Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to an engagement is limited to the total amount you paid us for the services giving rise to the claim.

We are not liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, business, goodwill, anticipated savings or data, however caused.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

17Cancellation & termination

Cancelling a project

You may cancel a project at any time with written notice. Work completed up to the cancellation date is invoiced and payable, and deposits are non-refundable. Any deliverables paid for in full transfer to you.

Cancelling a retainer

Retainers can be cancelled with the notice period stated in your agreement — 30 days unless specified otherwise. The current billing month is not refunded, and work continues through the notice period.

Termination by us

We may pause or end an engagement where invoices remain unpaid after notice, where we can't get the access or information needed to continue, or where conduct toward our team is abusive. In that event you'll be invoiced for work completed to date.

18Governing law

These terms and any dispute arising from them are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. You and we agree to the exclusive jurisdiction.

Before starting formal proceedings, both sides agree to attempt to resolve any dispute in good faith through direct discussion. Most things get solved with a phone call.

If any provision of these terms is found unenforceable, the rest remains in full effect.

19Changes to these terms

We may update these terms as our services or legal obligations change. The revision date at the top of this page reflects the current version.

Changes apply to engagements starting after the date they're published. Existing signed agreements continue under the terms in force when they were signed. Continuing to use this website after changes are published means you accept the updated terms.
